Definition of PII
PII means first name and last name or first initial and last name of an individual in combination with any one or more of the following data elements that relate to such individual:
a. Social Security number;
b. Driver’s license number or state-issued identification card number;
c. Financial account number, or credit or debit card number, with or without any required security code, access code, personal identification number or password, that would permit access to an individual’s financial account; and
d. Any combined individual information determined to be protected PII by applicable law(s).
Information We Collect
In operating our website, we may collect and process the following information about you:
- Our website and data collection devices can collect and use Internet Protocol (IP) addresses in our data collection processes. An IP address is a number assigned to your computer by your Internet service provider for access to the Internet. This allows the customer the ability to use the SaaS applications we provide, and allows installed data collection devices to provide data to Artis in order to deliver services described in the customer’s contract. Note, however, that depending upon a customer’s individual circumstances, it is possible that IP addresses that we collect, or even cookies we use or may develop in the future, may contain information that could be deemed PII. This is because a customer’s IP address may be static in nature and, therefore, can be associated with a customer’s personal computer or data collection device location. We may use your IP address to report aggregate information on use and to help improve our website.
- Information you provide to us when you enroll in our services and/or purchase our products including your contact information, financial information and account information.
- If you utilize our services, information you provide to us in relation to contract terms and conditions.
- If you create a customer account with us, we collect your contact information, username and password [other].
- RTIS customer account information, usernames, and passwords are encrypted and used solely for authorization and authentication purposes.
For all users of Artis’s website or other services, Artis does not collect PII about our customers unless they voluntarily submit that information to us.
By submitting a telephone number to Artis you agree that a representative of Artis can contact you at the number you provide, potentially using automated technology (including texts/SMS messaging) or a pre-recorded message. Your consent is not an obligation to receive any of our products and/or services.
By submitting your details on registration forms or other forms, you are indicating your consent to receive marketing or other emails from us. PII that customers provide may be used to send identified individuals information about our company, products and services, special offers, and newsletters. To opt out of receiving future communications, simply drop an email to specifying the contact information in sufficient detail for us to remove the individual(s) in question from such lists.
Customer Accounts and Confidential Information
Customers have the ability to download information from our SaaS applications that may be considered confidential information. Artis will protect the data under its control to the best of its ability, but once downloaded by the customer, the data becomes the responsibility of the customer to protect and control and Artis assumes no liability for such data. This includes screen snapshots, reports, and data downloads. Customers are required to maintain the security of the system access passwords used by them to access their online customer accounts. Artis assumes no liability for any disclosure resulting from customer’s failure to maintain their password security and integrity. Customers must notify Artis as soon as possible when they suspect or know that such a breach of their data or passwords has happened, so that system access passwords can be reset to protect the customer’s data from further disclosure. Customers are further required to notify Artis, in a timely manner, when such customer’s employees or other individuals given access to our SaaS applications under their auspices should be revoked. Artis assumes no liability for breaches of a customer’s data caused by such customer’s failure to protect system access passwords and/or not following timely notification procedures set forth in this paragraph.
Should Artis use web-based registration or other forms on our website and the customer chooses to use such electronic communication with Artis, we require the customer to provide accurate contact information. Artis will not implement instructions received from a non-authorized or non-verifiable individual. System directed changes can be only performed by individuals assigned the correct role for the task requiring the changes in our SaaS applications. It is the customer’s responsibility to notify Artis when such authorities change for an individual or employee of such customer. This precludes unauthorized triggering of demand asset response from our systems, for instance. Following these processes helps us deliver a high quality of customer service and satisfaction.
How We Use and Disclose Your Information
The information that we collect and store relating to you is primarily used to enable us to provide our products and/or services to you in the best possible manner. In addition, we may use the information for the following purposes:
- To provide you with information relating to our services and/or products;
- To provide third parties with statistical information about the users of our website;
- To monitor and conduct an analysis of our website traffic and usage patterns;
- To analyze business trends.
Customers that voluntarily participate in any Artis program or service will sign an agreement/contract whereby the provision of services by Artis is in exchange for the customer’s agreement to provide access to its energy or other collected data. Artis provides our customers with access to their data via Artis supplied Software as a Service (SaaS). Your data may be shared with Regional Transmission Operators (RTO’s), Lead Market Participants, utilities, and those required by law, administrative rule or regulation in meeting our mutual contractual obligations. Artis makes reasonable efforts to protect your data from disclosure and, subject to this section, does not disclose your customer data to third parties unless permitted or required to do so by law, or as set forth in this Notice. With that said, we do use third party service providers to help us fulfill our contractual obligations to you. Artis requires any such third party service providers to comply with the terms of this Notice.
Otherwise, Artis does not sell, disclose or otherwise make available to unauthorized third parties any of your information, including PII, except as described above or where the disclosure is for the following purposes:
Disclosure to Service Providers
Artis reserves the right to transfer your information, including PII, that has been voluntarily entered by you through our website to third parties who provide services to or for Artis. These parties are not allowed to use your information, except for the purpose of providing these services, and are required to maintain the confidentiality and security of the information on a basis comparable to the confidentiality and security requirements observed by Artis.
We reserve the right to transfer your information, including PII, to a third party in the event of a sale or other type of acquisition or merger of our company, so long as that the third party agrees to adhere to the terms of this Notice. You will be notified in the event of any such transfer, and you will be afforded an opportunity to opt-out.
We reserve the right to share your information, including PII, to respond to duly authorized information requests of governmental authorities or where required by law, and (where permitted by law) will use commercially reasonable efforts to provide advance notice so that you may contest the provision of such information to governmental authorities, should you so notify us.
Users Only of Legal Age of Majority
Our website and services are not intended for use by, directed toward, or designed to attract, individuals under the age of 13. By using our website, you affirm that you are at least 18 years of age or older. We are not liable for any damages that may result from a user’s misrepresentation of age.
No one under age 13 is authorized to submit or post any information, including PII, on our website. Under no circumstances may anyone under age 13 use our website. Parents or legal guardians of children under 13 cannot agree to these terms on their behalf.

To secure your information, we have put in place commercially suitable physical, electronic, and managerial procedures to safeguard and secure the information we collect on our website.
Nonetheless, the transmission of information via the internet is not completely secure and therefore we cannot guarantee the security of data sent to us electronically on our website, and transmission of such data is therefore entirely at your own risk.

Any PII we collect is maintained with the source of the information in the United States.
We retain the PII that we collect only as long as reasonably necessary to fulfill the purposes for which it was collected or to meet any legal requirements. We have retention standards that meet these requirements. Contractual provisions may supersede our retention standards.
